1. About Pascua
Pascua (also referred to as "Pascua App," "the App," "we," "us," or "our") is a Catholic faith formation and educational application designed for children aged 4 to 9 years old. The App is operated by Pascua, currently a sole proprietorship in the process of establishing a legal entity in Indonesia (hereinafter referred to as "Pascua," "we," "us," or "our").
Pascua provides interactive Bible stories, educational ebooks, mini-games, world exploration activities, quizzes, and faith content aligned with Catholic teachings and age-appropriate curriculum standards. The App is available on iOS (Apple App Store) and Android (Google Play Store).
These Terms of Service ("Terms") govern your access to and use of Pascua. "You" refers to the parent or legal guardian who registers an account and consents on behalf of their child. "Child" or "your child" refers to the minor who uses the App.

2. Eligibility & Parental Consent

A parent or legal guardian must complete registration and provide verified consent before any child can use the App. This is not optional — it is a legal requirement under COPPA (US), GDPR-K (EU), and Indonesia's UU PDP. > > - No child may register an account independently. > - The registering adult must be 18 years of age or older. > - By completing the parental consent screen during onboarding, you confirm you are the parent or legal guardian of the child who will use the App. > - You accept full responsibility for supervising your child's use of Pascua.
Verifiable Parental Consent (COPPA Compliance)
As required under the Children's Online Privacy Protection Act (COPPA) and applicable international laws, we obtain verifiable parental consent before collecting any personal information from children. Consent is captured during the onboarding flow when you, as a parent or guardian:
- Review and agree to these Terms of Service and our Privacy Policy;
- Provide your email address for account management and communication;
- Acknowledge that your child is between 4 and 9 years of age.
Age Assurance
If we have reason to believe that a user is under 18 and has registered without parental involvement, we reserve the right to suspend the account and notify the parent or guardian if their contact information is available. We will delete any personal data collected without proper consent.

3. Account Registration
Registration is performed by the parent or legal guardian. During registration, you will provide:
- Your email address (parent/guardian);
- Your child's display name (used in-app; does not need to be a real name);
- Your child's approximate birth month and year (to personalize content).
Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify us at info@pascua.app if you suspect any unauthorized use.
One Account Per Child
Each subscription supports one child profile. A device ID is associated with your child's progress and stored securely on our servers to enable cross-device continuity.
> No Social Features for Children > Pascua does not include chat, messaging, public profiles, user-generated content sharing, or any social interaction features accessible to children. Children cannot communicate with other users within the App.

4. Subscription & Payment
Pascua offers premium subscription plans to unlock the full content library. All payments are processed exclusively through Apple App Store or Google Play Store — Pascua does not directly collect or store any payment or credit card information.

> Note on Pricing: IDR pricing applies to Indonesian users billed via local App Store/Play Store storefronts. Prices shown are for the US (USD) and Indonesia (IDR); other countries follow Apple App Store and Google Play regional price tiers. Actual pricing may vary slightly by region due to App Store and Google Play regional pricing. Both monthly and annual subscriptions are available.
Free Trial
Pascua offers a 7-day free trial of premium access. You will not be charged during the 7-day free trial. If you do not cancel at least 24 hours before the trial ends, your selected subscription begins automatically and your App Store or Google Play account is charged at the standard price. You can cancel anytime during the 7-day free trial from your app store account to avoid being charged. The Bible and Profile remain free forever. The Bible and Profile remain free forever.
Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Renewal charges are processed through your App Store or Google Play account. To cancel, manage your subscription settings in your respective app store account.
Price Changes
We reserve the right to modify subscription prices. We will notify you at least 30 days in advance of any price change via the email address you registered with. Continued use after the price change takes effect constitutes acceptance of the new price.
> Parent/Guardian Authorization Required > All purchases must be made by the parent or legal guardian. Pascua does not permit in-app purchases by children. Parental controls on your device or app store account are strongly encouraged.

5. Refund Policy
Because payments are processed through Apple App Store or Google Play Store, refunds are governed by the respective platform's refund policies:
- Apple App Store: Request refunds at [reportaproblem.apple.com](https://reportaproblem.apple.com)
- Google Play Store: Request refunds through your Google Play order history within the applicable refund window.
Pascua does not process refunds directly. However, if you experience a technical issue preventing access to paid content, please contact us at info@pascua.app and we will work with you to resolve the issue or assist with your platform refund request.
Free Trial Abuse
Creating multiple accounts to repeatedly access free trials is prohibited and may result in account suspension.

6. Acceptable Use
You agree to use Pascua only for its intended purpose — Catholic faith formation and educational enrichment for your child. You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the App;
- Modify, adapt, translate, or create derivative works based on the App;
- Use the App for any commercial purpose without written permission from Pascua;
- Circumvent any technical measures or access controls;
- Attempt to gain unauthorized access to our servers, databases, or systems;
- Share subscription access credentials with individuals outside your immediate household;
- Use the App in any manner that could damage, disable, or impair our services;
- Scrape, crawl, or data-mine any content from the App.

7. Intellectual Property
All content within Pascua — including but not limited to illustrations, character designs, animations, music, narration, ebook layouts, game mechanics, interface design, and text — is the intellectual property of Pascua or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes only, for the duration of your active subscription.
Scripture texts used within the App are sourced from public domain translations. Curriculum alignment references (Cambridge Framework, Jolly Phonics) are used for educational description purposes only.
User-Generated Content
Pascua does not currently enable user-generated content submissions. In the event this feature is introduced in future versions, separate terms will govern such content.

8. AI-Generated Content
Pascua uses artificial intelligence tools — including Google Gemini ("Nano Banana" image generation), ElevenLabs (voice narration), and Magisterium AI (Catholic doctrine and daily-reading reflections) — to create educational content within the App. All AI-generated content is reviewed by human editors before being made available to users.
> Content Disclaimer: While we take care to ensure all content is age-appropriate, doctrinally sound, and educationally suitable, AI-generated content may occasionally contain imperfections. If you encounter any content that appears inappropriate or inaccurate, please report it immediately to info@pascua.app.
Pascua does not use AI to make automated decisions about users that produce legal or similarly significant effects. AI is used solely for content creation and personalization of the learning experience.

9. Service Availability
Pascua strives to provide a reliable service, but we do not guarantee uninterrupted availability. The App may be temporarily unavailable due to:
- Scheduled maintenance (we will endeavor to notify you in advance);
- Technical failures or outages beyond our reasonable control;
- Updates, patches, or improvements to the App;
- Force majeure events including natural disasters, pandemics, or government actions.
We reserve the right to modify, suspend, or discontinue any feature or the entire App at any time. In the event of permanent discontinuation, subscribers will be notified at least 30 days in advance and provided a pro-rated refund for unused subscription time.

10. Disclaimers & Limitation of Liability
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Pascua does not warrant that:
- The App will be error-free or uninterrupted;
- Defects will be corrected;
- The App or servers are free of viruses or harmful components.
Limitation of Liability
To the maximum extent permitted by applicable law, Pascua and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the App.
Our total cumulative liability for any claim related to the App shall not exceed the amount you paid for the App subscription in the 12 months preceding the claim.
Faith & Religious Content Disclaimer
The religious and faith content within Pascua is intended for educational purposes and reflects Catholic teaching. It is not a substitute for formal religious instruction, sacramental preparation, or the guidance of a qualified priest or clergy member.

11. Termination
Either party may terminate this agreement at any time.
Termination by You
You may terminate your account at any time by:
- Cancelling your subscription through the App Store or Google Play;
- Submitting an account deletion request within the App under Settings → Privacy → Delete Account;
- Emailing a deletion request to info@pascua.app.
Termination by Pascua
We reserve the right to suspend or terminate your account, with or without notice, if we determine that:
- You have materially breached these Terms;
- Your use poses a security risk or technical harm to the App or other users;
- Required by applicable law or regulatory authority.
Upon termination, your right to access the App ceases immediately. Data deletion will follow the timeline described in our Privacy Policy.

12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising from or relating to these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation.
If negotiation fails, disputes shall be submitted to the jurisdiction of the competent courts in Indonesia, without prejudice to your rights under the consumer protection laws of your country of residence.
> Consumer Rights Preserved: Nothing in these Terms limits or excludes your statutory rights as a consumer under the laws of your country of residence. If local law grants you rights that cannot be waived by contract, those rights are not affected by these Terms.

13. Changes to These Terms
We may update these Terms from time to time. When we do, we will:
- Update the "Last Updated" date at the top of this document;
- Notify you via the email address associated with your account at least 14 days before material changes take effect;
- Display an in-app notification prompting you to review and re-accept the updated Terms.
Your continued use of the App after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and cancel your subscription.
